DMCA / Copyright Policy

Welcome to Xtra Shift ES (“Company,” “we,” “our,” or “us”). We respect the intellectual property rights of others and expect all users of our platform to do the same.

This Digital Millennium Copyright Act (“DMCA”) and Copyright Policy explains how copyright owners may report alleged copyright infringement and how we respond to such claims.

Users are solely responsible for ensuring they own or have permission to use any content they upload.

2. Copyright Infringement

You may not upload, copy, distribute, reproduce, or display copyrighted material without authorization from the copyright owner.

3. Filing a DMCA Notice

If you believe content on our Platform infringes your copyright, please submit a written notice including:

  3. Telephone number.
  4. Email address.
  5. Identification of the copyrighted work claimed to have been infringed.
  6. Identification of the infringing content, including its URL or other information sufficient for us to locate it.
  7. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  8. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.
  9. Your physical or electronic signature.

5. Removal of Infringing Content

Upon receiving a valid DMCA notice, we may:

  • Remove the allegedly infringing material.
  • Disable access to the content.
  • Notify the user who posted the material.
  • Suspend or terminate the user’s account if appropriate.

We reserve the right to investigate all claims before taking action.

6. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:

  • Your name, address, telephone number, and email address.
  • Identification of the removed material.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.
  • A statement consenting to the jurisdiction of the appropriate federal court.
  • Your physical or electronic signature.

Counter-notices should be sent to the DMCA Agent listed above.

If appropriate under applicable law, we may restore the removed content unless the original complainant files legal action within the required timeframe.

7. Repeat Infringers

We maintain a policy of terminating accounts of users who repeatedly infringe the intellectual property rights of others.

We may suspend or permanently remove accounts after repeated violations or serious instances of infringement.

8. False Claims

Submitting false or misleading copyright infringement notices or counter-notifications may result in legal liability.

Users should only submit claims they honestly believe are accurate.

9. User Responsibility

Each user represents and warrants that:

  • They own the content they upload or have all necessary rights and permissions.
  • Their content does not violate copyright, trademark, patent, trade secret, or other intellectual property rights.
  • Their content does not infringe the rights of any third party.

Users agree to indemnify and hold harmless Xtra Shift ES from claims arising out of content they submit.

11. Platform Role

Xtra Shift ESoperates solely as an online marketplace connecting customers with independent contractors.

We do not verify ownership of every image, portfolio item, document, or other content uploaded by users before publication.

We reserve the right to remove content that violates this Policy or applicable law.

12. Changes to this Policy

We may update this DMCA/Copyright Policy from time to time.

The updated version becomes effective when posted on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Policy.
